"The Dir En Grey Biggest Fan Video Contest" – Official RulesGENERAL INFORMATION: The sponsor of "The Dir En Grey Biggest Fan Video Contest" is The End Records (the "Sponsor"), having a place of business at 94 Bogart Street Brooklyn, NY 11206. The Contest begins on October 24, 2011 and ends on November 21, 2011 (the "Contest"). The Contest is subject to the following official rules (the "Official Rules").NO PURCHASE OR FEE IS NECESSARY TO ENTER OR WIN, NOR WILL IT INCREASE THE ODDS OF WINNING. BUYING WILL NOT HELP YOU WIN. THE CONTEST IS VOID WHERE PROHIBITED, TAXED OR RESTRICTED BY LAW. ALL FEDERAL, STATE AND LOCAL LAWS AND REGULATIONS APPLY. PARTICIPATION CONSTITUTES ENTRANT'S FULL AND UNCONDITIONAL AGREEMENT TO AND ACCEPTANCE OF THESE OFFICIAL RULES.ELIGIBILITY: The Contest is open to natural persons ages eighteen (18) and over who are legal residents of the fifty United States (excluding Texas and excluding all other United States and foreign territories and possessions) for the duration of the Contest. The following are not eligible to participate in the Contest: employees, agents and representatives of the Sponsor, its subsidiaries, its affiliated companies, its controlling corporations, its advertising or promotion agencies, sponsors, suppliers of materials, Prizes (as defined below) and services related to the Contest, or any other person directly associated with the holding of the Contest, as well as members of their immediate families (parents, siblings, children), their legal or common law spouse, and any persons residing with those employees, agents and representatives. HOW TO ENTER: NO PURCHASE NECESSARY. An individual wishing to submit an entry (an "Entrant") may do so in one of two ways: 1.    Online Entry. Persons who “like” the contest on the contest page can see the guidelines and how to submit their video by the Sponsor. Videos must be posted by November 21, 2011. Online contestants who are drawn as a potential winner must agree to be bound by these Official Rules before being deemed a valid Entrant and becoming eligible for receiving any Prizes.2.    Mail Entry. We are not receiving mailed entries. LIMITATION ON NUMBER OF ENTRIES: Only one entry per person. Multiple entries by any Entrant or e-mail address will result in a disqualification of all attempted entries by that Entrant and/or e-mail address. PRIZES AND SELECTION OF WINNERS: On or after November 21, 2011, the potential winners of the Contest (the "Winner") will be selected by a representative or member of the Sponsor. Subject to the terms and conditions in these Official Rules, one (1) Entrant will receive the "Prize" (as described below). If Winner does not agree to and comply with Official Rules, an alternate will be chosen. The Prize will consist of (2) tickets to Dir en Grey’s upcoming national tour.Without limitation of any other term or condition in these Official Rules, the Prize is subject to these following terms and conditions:- Sponsor reserves the right to substitute a prize of equal or greater value if the Prize become unavailable for any reason whatsoever.- All federal, state, and/or local taxes are the sole responsibility of the Winner.- If the Prizes are not properly and timely claimed, no compensation will be awarded to the Winner.- No Prize substitution or cash redemption will be allowed by the Winner.- The Prizes are not transferable.- The Sponsor will not provide transportation to the concert, nor will provide monetary compensation for any travel costs.- Other restrictions may apply.ODDS OF WINNING: Odds of winning the Prize depends on the number of eligible entries submitted during the Biggest Fan Video Contest submission period (i.e., one (1) divided by the number of eligible entries). WINNER NOTIFICATION AND QUALIFICATION: The Sponsor will attempt to notify the Winner by e-mail. The name of the Winner can also be obtained by visiting the following website on or after November 21, 2011 (depending on the date of the drawing): http://www.theendrecords.com.  The Winner listed as such on that website, but who has not been notified, may request notification by first class mail or e-mail, by e-mailing his/her request to NEED EMAIL or mailing his/her request to Sponsor at: Biggest Fan Video Contest, c/o The End Records, 94 Bogart Street Brooklyn, NY 11206. Sponsor may require the Winner, in order to qualify for the Prizes, to return to the Sponsor, for receipt by the Sponsor no later than ten (10) days from the date the notification was sent to the Winner (unless extended in Sponsor's sole discretion), a form of document as provided by the Sponsor along with the notification (the "Declaration Form") which may include one or more of the following: an affidavit or other declaration of eligibility and compliance with these Official Rules; a publicity release; a release, waiver and indemnity of the Sponsor and its directors, officers, employees, agents, shareholders, parent companies, subsidiaries, affiliated companies and insurers from all liability arising out of and in connection with the Biggest Fan Video Contest, the Prizes, and his/her participation therein; except where prohibited by law, an authorization for Sponsor and its designees to use the Winner's name, likeness, biographical materials, and statements concerning the Contest, Prizes, Event, Band, and Album without compensation or further consent, for promotional and advertising purposes; an IRS Form W-9 (and/or similar state income tax documentation); and/or photographic identification in the form of a government-issued document to verify the information supplied by the Winner. Failure of the Winner to timely return a fully and properly completed Declaration Form, or failure to meet any of the terms and conditions of these Official Rules, may result in the Winner's disqualification, at the Sponsor's sole discretion. If the Sponsor is unable to notify the Winner, if the notification is returned as undeliverable, or if the Winner's Declaration Form is untimely, incomplete, or shows that Winner is not in compliance with the Official Rules, the Sponsor shall have the option to disqualify the Winner. In that event, the Sponsor will select an alternate Winner in substitution for the disqualified Winner from a further viewing of the entered videos (also subject to all of the terms and conditions of these Official Rules).All entries will become the exclusive property of the Sponsor and the Sponsor will have no obligation to acknowledge or return them. Sponsor's decision as to the selection of the Winner shall be final.PRIZE DELIVERY: The Winner will be informed by e-mail as to how to take possession of the Prize. In the event that the Prize is mailed to the Winner with the Winner's consent, the Winner shall assume the risk of its loss or damage in transport and the Sponsor shall not be responsible for the safe arrival of the Prize. The Sponsor may choose to give the Winner the option of purchasing insurance for the shipment of the Prizes at the Winner's sole cost and expense.LIMITATION OF LIABILITY; DISCLAIMERS: BY ENTERING THE CONTEST, ALL ENTRANTS AGREE TO BE BOUND BY THESE OFFICIAL RULES, AND AGREE TO RELEASE AND HOLD HARMLESS SPONSOR AND ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, SHAREHOLDERS, PARENT COMPANIES, SUBSIDIARIES, AFFILIATED COMPANIES AND INSURERS, ADVERTISING OR PROMOTIONAL AGENCIES, SPONSORS, SUPPLIERS OF MATERIALS, PRIZES AND SERVICES RELATED TO THE CONTEST, AND ANY OTHER PERSON DIRECTLY ASSOCIATED WITH THE HOLDING OF THE CONTEST, (THE "RELEASED PARTIES"), FROM ANY AND ALL LIABILITY FOR INJURIES, LOSSES OR DAMAGES OF ANY KIND THAT RESULT FROM THE ACCEPTANCE, POSSESSION OR USE OF THE PRIZE OR FROM ENTRY OR ATTEMPTED ENTRY INTO THE CONTEST, INCLUDING BUT NOT LIMITED TO ANY INJURY OR DAMAGE TO ENTRANT'S OR ANY OTHER PERSON'S COMPUTER RELATED TO OR RESULTING FROM DOWNLOADING ANY MATERIALS IN CONNECTION WITH THE CONTEST. THE RELEASED PARTIES ASSUME NO LIABILITY FOR LOST OR MISDIRECTED ENTRIES, WHETHER DUE TO TECHNICAL OR COMPUTER MALFUNCTION, FRAUD, ERROR, OR OTHERWISE. THE SPONSOR RESERVES THE RIGHT, IN ITS SOLE DISCRETION, TO CANCEL, TERMINATE OR SUSPEND THE CONTEST IN ITS ENTIRETY IN THE EVENT THE SITE IS INFECTED BY A VIRUS, OF A SOFTWARE OR HARDWARE OR NETWORK ERROR OR DISRUPTION, THE SITE IS HACKED, UNAUTHORIZED HUMAN INTERVENTION OCCURS, OR OF ANY OTHER CAUSE BEYOND THE SPONSOR'S CONTROL THAT COULD COMPROMISE OR AFFECT THE ADMINISTRATION, SECURITY, IMPARTIALITY OR NORMAL OPERATION OF THE CONTEST. SPONSOR IS NOT RESPONSIBLE FOR TYPOGRAPHICAL OR OTHER ERRORS IN THE PRINTING, THE OFFERING OR THE ADMINISTRATION OF THE CONTEST, OR IN THE ANNOUNCEMENT OF THE PRIZES. The Sponsor will not otherwise use such information, except that, without limitation of any other right of Sponsor, each Entrant agrees that the Sponsor may contact him/her by mail or e-mail from time to time regarding information, special offers and promotions relating to Sponsor's businesses.APPLICABLE LAWS AND DISPUTE RESOLUTION: The construction, validity, interpretation and enforceability of these Official Rules shall be governed by the laws of the State of New York. Any and all disputes arising out of or related to this Contest will be resolved individually, and without resort to class action, exclusively by a state or federal court located in New York County, New York. Should there be a conflict between the laws of the State of New York and any other laws, the conflict will be resolved in favor of the laws of the State of New York. All judgments or awards shall be limited to actual out-of-pocket damages (excluding attorneys' fees) associated with participation in this Contest, and shall not include any indirect, punitive, incidental and/or consequential damages (which damages are expressly disclaimed by the Sponsor). If any provision of the Official Rules is found by a court of competent jurisdiction to be illegal, unenforceable or void, then such provision will be null and void but each other provision not so affected will be enforced to fullest extent permitted by law.THE BAND IS NOT A SPONSOR: The Band is not, and shall not be deemed to be, a Sponsor of the Contest.
